§ 1 Subject matter of the program and agreement; participation

(1) By completing and entering the data required for participation in the My MeisterSinger Program (hereinafter “MMP”), confirming the selection windows required for the application, and electronically sending the participation application to MeisterSinger, the customer applies for participation in the MMP.

The admission of the customer to participate in the MMP and the resulting participation agreement between the customer and MeisterSinger result from a notification to the customer (by e-mail or post).

(2) Participation in the MMP as well as special benefits being possibly granted in favor of participants of the program are in return for the provision of the personal data supplied by the customer in the participation application, so that MeisterSinger may use this data for implementing and processing the MMP and informing the customer by e-mail or mail about watch or watch accessory offers, special MeisterSinger promotions, new releases of limited models and special models as well as special promotions reserved for MMP participants and surveys on new MeisterSinger watches/watch accessories. In all other respects, participation is free of charge. Any natural person who has reached the age of 16 is eligible to participate. MeisterSinger may deny participation to some persons for factual reasons.

(3) The subject of the application is participation in the MMP. Participation in the MMP grants the customer the opportunity to be informed about specific (including recurring) offers as well as special MeisterSinger promotions, in particular for a limited period of time, for MMP participants, using the contact details provided. The subject of limited special promotions may be, for example, the granting of special accessories, discounts, or other benefits in connection with the status as an MMP participant or the purchase of certain MeisterSinger products.

(4) The operator of the MMP and user of the data supplied by the customer is MeisterSinger.

 § 2 Participation in the MMP and participation requirements

(1) Only owners of a MeisterSinger brand wristwatch for private use are eligible to participate.

(2) The following data must be provided to MeisterSinger by the customer upon registering to participate:

• First name, last name
• Address (street, house number, postal code, city, country)
• Contact e-mail address
• Watch model and serial number of a MeisterSinger wristwatch owned by the participant
• Specification of when and where the watch was purchased

If one or more pieces of the above information are missing, participation in the MMP is not possible. MeisterSinger reserves the right to check the accuracy of the information at any time and, if necessary, to request appropriate proof of accuracy.

MeisterSinger further reserves the right to disqualify participants and exclude them from participation in the MMP if false information is provided during registration (participation under someone else’s name) or if the participant manipulates or attempts to manipulate any special promotions associated with participation in the MMP and/or otherwise violates these Terms and Conditions of Participation. Manipulation includes multiple registrations of a person or automated collective participation services.

MeisterSinger is entitled to reject a customer’s participation application if MeisterSinger is of the opinion that one or more of the participation requirements relating to the customer and/or the MeisterSinger product purchased by the customer are not met at the time of the declaration of participation. MeisterSinger will inform the customer about the rejection of his/her participation application and the reasons for the rejection.

(3) Only one participation in the MMP is possible per natural person, this means multiple participation (e.g. if several MeisterSinger watches are owned) is excluded. In the relationship with MeisterSinger, the customer is obliged to prove that the participation requirements related to his/her participation application exist and are being complied with.

(4) By providing the customer data, MeisterSinger grants the customer e.g. the opportunity to participate in any special promotions, special sales, (pre-) releases, in particular as far as these are intended for the exclusive group of MMP participants, and regularly informs the customer by e-mail or mail about watch or watch accessory offers, special MeisterSinger promotions, new releases of limited models and special models as well as special promotions reserved for MMP participants and surveys about new MeisterSinger watches/watch accessories. Information on this can be obtained during normal business hours from MeisterSinger and the respective designated partner business locations by telephone, e-mail, or in person on-site.

(5) MeisterSinger reserves the right to change, limit, or exclude the scope of the MMP at any time, in particular with regard to special offers/promotions for participants, for example within the scope of special promotions, if other discounts or benefits are granted, etc.

 § 3 Registration bonus and reservation of powers

(1) If, in relation to an eligible customer, the conditions for participation pursuant to the aforementioned § 1 and 2 are met in full and, in addition, the following conditions for claiming the registration bonus are fulfilled, MeisterSinger shall grant a one-time extension of the manufacturer’s warranty (warranty conditions available at https://www.meistersinger.com/de/garantie/) by one year in relation to the MeisterSinger watch specified by the customer in his/her registration, for which the registration bonus is to be claimed in the course of the registration. This extends the MeisterSinger manufacturer’s warranty for the watch specified by the customer to a total of three years, calculated from the date of purchase of the MeisterSinger watch registered for the special bonus. A further prerequisite for claiming the registration bonus “Warranty extension” is, in addition to meeting the requirements for participation in the MMP, that the MeisterSinger wristwatch specified in the registration for the warranty extension was demonstrably purchased from MeisterSinger or an authorized dealer after 06/30/2021 and that the customer’s initial registration for the MMP also took place after 06/30/2021.

Should the requirement for claiming the registration bonus be met – the content and scope of the extended manufacturer’s warranty are governed by the warranty conditions of the manufacturer’s warranty (warranty conditions available at https://www.meistersinger.com/de/garantie/). It is expressly stated that neither the contents of the warranty conditions nor the regulations for claiming the registration bonus and any resulting extension of the manufacturer’s warranty shall limit or restrict any existing statutory rights and warranty claims of a customer; these shall remain unaffected.

(2) MeisterSinger reserves the right to prematurely terminate the granting of the registration bonus in whole or in part at any time, even without observing any deadlines, or to modify the process, if it is not possible to ensure proper implementation of the special promotion for technical or legal reasons and/or circumstances of force majeure or external circumstances beyond MeisterSinger’s control require a modification, suspension, or termination of the special promotion. These possibilities also exist when

• manipulations are detected or for other reasons a proper implementation of the registration bonus cannot be guaranteed (e.g. of hardware or software, in case of program errors, computer viruses)
• unauthorized interference by third parties with MeisterSinger’s hardware or software with regard to the registration bonus and in particular the customer data used for this purpose is detected, as well as
• mechanical, technical, and/or legal reasons prevent a continuation of the registration bonus.

Compensation claims of the customers in case of such modification, suspension, and/or termination against MeisterSinger are excluded.

Any declarations of participation already received prior to any revocation or other termination of the registration bonus and the granting of the registration bonus in relation to such customers shall remain unaffected by the above provisions on revocability and termination of the registration bonus. This does not apply if other reasons that exclude the participation of the customer exist or are subsequently determined.

(3) An obligation on the part of MeisterSinger to maintain the relevant registration bonus granted shall not be established and shall not be assumed on the part of MeisterSinger. Before participating in the MMP, the customer is responsible for finding out whether MeisterSinger will continue to grant a registration bonus for this at the time of participation.

 § 4 Use of personal data/data protection

(1) MeisterSinger collects and uses the customer data (name, address, e-mail address) to process any benefits offered to and claimed by an MMP participant (e.g. free additions for MMP participants) for the execution of this agreement.

Furthermore, MeisterSinger uses this data to inform the customer via e-mail or mail about watch or watch accessory offers, special MeisterSinger promotions, new releases of limited models and special models as well as special promotions reserved for MMP participants and surveys about new MeisterSinger watches/watch accessories.

(2) The customer may object to the use of personal data for advertising and marketing purposes at any time by informally notifying MeisterSinger.

(3) The data protection information and conditions can be accessed at any time at the web address www.meistersinger.com/de/datenschutz.

 § 5 Liability

(1) MeisterSinger is liable without limitation with regard to the customer’s participation in the MMP in case of intent, fraudulent intent, and gross negligence as well as in the event of personal injury.

(2) MeisterSinger shall be liable for damages in the event of a slightly negligent breach of a material contractual obligation (cardinal obligation) limited to the amount of the foreseeable damage typical for the agreement. In this case, the provider is not liable for lost profits, indirect damages, consequential damages, and claims of third parties. Cardinal obligations within the meaning of this provision shall include, in addition to the main contractual obligations, obligations the fulfillment of which is a prerequisite for the proper performance of the agreement and compliance with which the customer may regularly rely on.

(3) In all other respects, any liability on the part of MeisterSinger is excluded, unless mandatory liability is prescribed by law.

 § 6 Changes and discontinuation of the MMP

(1) MeisterSinger reserves the right to amend the Terms and Conditions of Participation in the MMP while safeguarding the legitimate interests of the customer. In this case, however, the new Terms and Conditions of Participation shall only apply if (1) MeisterSinger has notified the customer of the amendment in writing and (2) the customer does not raise an objection with MeisterSinger within one month after receipt of the amendment notification. MeisterSinger shall expressly notify the customer of this legal consequence in the amendment notification. If the customer does not accept the new Terms and Conditions of Participation in accordance with the above, this shall be deemed to be termination of the agreement on participation in the MMP by the customer in accordance with § 7.

(2) MeisterSinger also reserves the right to discontinue the MMP at any time without stating reasons.

 § 7 Term and termination

(1) Participation in the MMP is for an indefinite period of time, this means without a time limit.

(2) The customer as well as MeisterSinger may terminate this Agreement at any time without notice by sending an electronic communication (e-mail is sufficient) to the other party.

(3) Any benefits already claimed by the customer in accordance with these Terms and Conditions of Participation at the time of termination or discontinuation of participation in the MMP shall remain unaffected.

 § 8 Final provisions

(1) Participation in the MMP is subject to the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) The legal venue for all disputes arising from or in connection with this participation agreement shall be the provider’s domicile.
