II. What principles do we adhere to?

In compliance with data protection regulations, we only process your personal data as allowed by law, or if you have given consent. This also applies to the processing of personal data for advertising and marketing purposes.

On this website we may also collect data which does not permit making any direct inferences regarding your identity. In certain cases – especially in combination with other data – this data can however constitute “personal data” within the meaning of data protection law. Furthermore, on this website we may also collect data which cannot be utilized to identify you either directly or indirectly, such as aggregated data on all users of this website.

III. What data do we process?

You can access our website without directly providing personal data (such as your name, postal address or e-mail address). We still however have to collect and store certain data to enable you to access our website. We also utilize certain analytics tools on this website, into which third-party functionalities are integrated (“social plugins”).

1. Log files: When you visit this website, our web server automatically saves the domain name or IP address of the querying computer (typically your internet service provider), including the date, time and duration of your visit, what subpages/URLs you visit and data on the software and devices you are using to view our webpages.

2. Cookies: Like many prominent companies, we utilize “cookies” to make our site as user-friendly as possible. Cookies are small text files which are stored in the internet browser you are using. These files help us identify certain browsing preferences of our visitors to tailor our website accordingly. Most of the cookies we utilize are “session cookies”. These are automatically deleted when your website visit ends (upon closing your browser). 3. Google Tag Manager: We utilize Google Tag Manager, a service with a user interface for managing webpage tags, particularly the tools listed below. Google Tag Manager only implements tags. This means that Google Tag Manager does not use cookies, and does not at this time collect personal data. Google Tag Manager triggers other tags which may collect data, but Google Tag Manager does not access that data. If certain websites are disabled at the domain or cookie level, all tracking tags implemented by Google Tag Manager are disabled.

4. Google Analytics: On our website we utilize Google Analytics, a web analytics service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”) for the purpose of continuous improvement of our website. Google Analytics also uses cookies, which are stored on your computer to allow analysis of your website usage. The information generated by the cookie about your use of this website is usually sent to a Google server in Europe (or in a member state of the European Economic Area) for anonymization of the IP address so as to rule out the possibility of identifying you personally. After anonymization of the IP address, the truncated IP address is sent to a Google server in the US where it is saved. Only in exceptional cases is the full IP address sent to a Google server in the US and truncated there. Google Analytics is used on this website with an extension enabling the anonymized collection of IP addresses (“IP masking”).

Google uses the collected data on our behalf to evaluate your use of the website, compile reports on website activity and provide us other website-related services. The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data.

When the purpose no longer applies and we cease using Google Analytics, the data collected in this context will be deleted. We also have Google Analytics configured so that your data are automatically deleted after a period of 14 months.

Disabling Google Analytics: You can prevent the storage of cookies by configuring your browser software accordingly. Please be advised however that in such case you may not be able to fully utilize all functionalities of this website. 5. Facebook Pixel: On our websites we utilize the “Facebook Pixel” service provided by the social media network Facebook: Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. If you are resident in the EU the address is: Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (hereinafter: “Facebook”).

Facebook Pixel allows Facebook to identify you as a visitor to our website as a target group member for the displaying of advertisements (“Facebook Ads”). We thus utilize Facebook Pixel to display the Facebook Ads we are running solely to Facebook users who have demonstrated an interest in our online offering or have certain attributes (such as interest in specific topics or products indicated by visiting particular webpages). We transmit this data to Facebook (“Custom Audiences” without advanced matching). We also utilize Facebook Pixel to ensure that our Facebook Ads are aligned with the probable interests of users and not perceived as annoying. Facebook Pixel also enables us to statistically analyze the impact of Facebook Ads for market research purposes by tracking whether users have been directed to our website after clicking on a Facebook Ad (“conversion”).

EU-US Privacy Shield: Facebook is certified under the Privacy Shield Framework, a convention designed to ensure compliance with data protection standards under European law.

Legal basis: We have a legitimate interest in analyzing user behavior in order to optimize our website and our advertising.

Objection: You can object to data collection via Facebook Pixel and to use of your data for the displaying of Facebook Ads. To configure the kinds of ads you see within Facebook, you can use the corresponding page provided by Facebook and follow the instructions for configuring usage-based advertising. 7. Google Remarketing: On our website we utilize the Remarketing and “Custom Audiences” functionalities provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”) for the purpose of studying visitor behavior and interests.
Google utilizes cookies to perform website usage analysis for the purpose of creating interest-based advertisements. Cookies are employed to record website visits and anonymous data on website usage. 13. Online ordering

You can place an order on our website as a “guest” without having to register and create a customer account. In such case, the data required to process the order are requested (such as first and last name, billing and delivery address, your e-mail address, necessary payment information, delivery modalities and order information).

14. Registration and creating a customer account

When registering as a user, and creating a customer account in particular, we collect personal data via the registration form on our website. We may require that you re-enter data collected in the registration process (particularly in order to identify you) and may collect additional personal data if you wish to use certain content on our website or place an order.

15. Comment function

On our blog we make it possible to comment on our blog entries. In order to post your content, you must provide your name and e-mail address. Your e-mail address will not be published.

 

 

IV. Data security and encryption

We utilize SSL (Secure Socket Layer) server security software to encrypt all of your personal data, such as name, address and credit card number. This data is not visible to unauthorized parties when transmitted via the internet. The SSL server security software employed encrypts the characters you enter into a code for secure internet transmission.

The following data are transmitted in encrypted form:

­         Personal data (name, address, telephone number, etc.)

­         Login data (e-mail address and password)

­         Payment option

­         Credit card, account and other payment-related data

V. For what purposes and on what legal basis do we process your data?

1. Personal data which may be contained in log files is processed to enable you to use our website; this is done on the basis of Article 6 (1) f) GDPR in fulfillment of our legitimate interest in the operation of our website.

2. Data collected via cookies, including the web analytics services Google Analytics, Google Remarketing, Google AdWords and Facebook Pixel, the listed plugins and pseudonymous usage profiles, is collected for the purposes of advertising, market research and designing our website to accord with the needs and interests of users. We have a legitimate interest in such analysis of use of our website on the legal basis of Article 6 (1) f) GDPR.

3. When you place an order through our website, register on our website as a user or for a customer account or comment on a blog entry, we process the data collected for those activities to fulfill contracts concluded with you and to provide our services on the basis of Article 6 (1) b) GDPR.

4. We may also process this data in connection with your use of our website in fulfillment of our legal obligations on the basis of Article 6 (1) c) GDPR.

5. In addition to the aforementioned purposes we also process your data as necessary to uphold our legitimate interests or the legitimate interests of third parties on the basis of Article 6 (1) f) GDPR. Our legitimate interests include:

a) asserting legal claims and defending against lawsuits

b) preventing and investigating criminal activity

c) managing and growing our business, including risk management

VI. Am I obligated to provide data?

The data required to fill online orders, register as a user and create a customer account are designated as mandatory in the corresponding area of the website. You cannot utilize these functionalities unless you provide this mandatory data.

When collecting any other personal data from you, we notify you of whether collection of this data is required by law or contractual provision or to conclude a contract. In doing so we in most cases specify what data is provided voluntarily rather than on the basis of any of the aforesaid obligations or in order to conclude a contract.

VII. Who receives my data?

Your personal data is generally processed internally by our company. Depending on the type of personal data concerned, only specific organizational units will have access to your personal data, including particularly our IT department and other departments involved in the provision of our digital offerings (websites, etc.).

We may also transfer your personal data to third parties external to our company as allowed by law. These parties include:

1. Goods suppliers. To the extent your personal data is necessary for the conclusion, structuring or amendment of a contract (existing data), such data are utilized exclusively for performance of contract, such as disclosing your name and address to the goods supplier for goods delivery. This applies to self-pickup from a selected jeweler and to direct shipping as well, because the selected jeweler is available to you as local contact and for customer service (especially in case of a complaint). Your personal data will not be disclosed to third parties not involved in performance of the contract without your express consent or a legal basis for doing so.

VIII. Are data transferred to countries outside the EU/EEA?

Your personal data are generally processed within the EU or the European Economic Area.

Data may only be transferred to recipients in so-called “third countries” in connection with the usage of service providers to provide web analytics services. “Third countries” are countries outside the European Union or the Agreement on the European Economic Area which do not afford a level of data protection comparable to the European Union without special agreements.

If the data transferred includes personal data, we will ensure that the required level of data protection is guaranteed in the third country or by the recipient in the third country prior to transmission. In particular, this may be confirmed by means of an “adequacy decision” by the European Commission stating that an on the whole adequate level of data protection is afforded in a given third country. Alternatively, we may transfer data on the basis of EU Standard Contractual Clauses agreed with a recipient, or in the case of US recipients on the basis of adoption of the provisions of the EU-US Privacy Shield. IX. Is automated decision making utilized?

We generally do not utilize automated decision-making (including profiling) within the meaning of Article 22 GDPR in connection with the operation of our website. If we do utilize such procedures in an exceptional case, we will notify you separately thereof if and as legally required.

X. For how long will my data be stored?

We generally store your personal data for as long as we have a legitimate interest in doing so, as long as you do not have an overriding interest in the cessation of such storage. In the absence of a legitimate interest we can continue to store data if legally required to do so (for example to fulfill retention obligations under tax or commercial law).

Your data will be restricted from further use upon full performance of the contract. We delete your personal data without action on your part upon becoming aware that the data are no longer necessary to fulfill the purpose of processing or if storage is otherwise legally prohibited.

In general,

­          log file data are deleted within seven days unless longer storage is required by law for such purposes as uncovering misuse and identifying and eliminating technical malfunctions,

­          data processed in connection with an order are deleted no later than the date of expiry of the applicable statutory retention period, and

­          data processed in connection with a user or customer account registration are deleted upon completion of registration or deletion of the customer account.

XI. What rights do I have?

You have the right as data subject

          to receive information on what personal data of yours are stored pursuant to Article 15 GDPR,

­          to the correction of incorrect or incomplete data pursuant to Article 16 GDPR,

­          to the deletion of personal data pursuant to Article 17 GDPR,

­          to restriction from processing pursuant to Article 18 GDPR,

­          to data portability pursuant to Article 20 GDPR, and

­          to file objection to the processing of your personal data pursuant to Article 21 GDPR.

Pursuant to Article 77 GDPR you furthermore have the right to file complaint with a competent supervisory authority for data protection.
